Under the instructions from and on behalf of my client Mr. Dinesh Kumar S/o Rajveer Singh R/o I Block, House No. 75, Shiv Durga Vihar, Lakkar pur nearby ideal public school, Faridabad, Haryana- 121009. I do hereby serve you with the following legal notice, the contents of which are set forth herein below:

•  That my client is a consumer as he had purchased Johnson and Johnson baby products from Delhi Medicos bearing memo no. 47,860, the addressee, vide your receipt dated 21/09/2022 by paying a bill of Rs 903. That the said product/service is not up to the mark due to the following defect:
•  That the Johnson and Johnson baby products were purchased for my 3 months baby. The products resulted in full body rashes and half head hair remove.
•  Than we met dermatologist regarding the same, Dr Ishita Kapoor and Dr. Akshra Patel. They said that the baby got rashes and half head hair remove due to the use of said defected Johnson and Johnson company products.

2 (11) defines "deficiency" means any fault, imperfection, shortcoming or inadequacy in the quality, nature and manner of performance which is required to be maintained by or under any law for the time being in force or has been undertaken to be performed by a person in pursuance of a contract or otherwise in relation to any service and includes-

(i) any act of negligence or omission or commission by such person which causes loss or injury to the consumer; and

(ii) deliberate withholding of relevant information by such person to the consumer,

2 (21) "goods" means every kind of movable property

2 (22) "harm", in relation to a product liability, includes

(ii) personal injury, illness or death;

(iii) mental agony or emotional distress attendant to personal injury

Sec.2(34) Clearly states "product liability" means the responsibility of a product manufacturer or product seller, of any product or service, to compensate for any harm caused to a consumer by such defective product manufactured or sold or by deficiency in services relating thereto;

In such facts and circumstances, as stated herein above in the present legal notice, I hereby call upon you, the addressee, to pay complete medical charges inclusive of doctor fee, medicine charges etc. applicable on your part immediately within 15 days from the receipt of this legal notice. You are liable to pay a sum.
